DINE SAFE TORONTO: 1 Closure, 13 Conditional Passes For Restaurants This Week

This week, Toronto Public Health issued one closure and 13 conditional passes to food establishments for crucial and significant Food Premises Regulation infractions.

One or more such infractions were observed at each noted establishment during inspections between Wednesday, May 22 and Tuesday, May 28.

Food establishments in this report include restaurants, food court vendors and takeout food locations.

CLOSURE

Restaurant

A closure was issued after the following Food Premises Regulation infractions were observed during an inspection May 22.
  • Food premise maintained in manner permitting health hazard (rodents).• Food premise maintained in manner adversely affecting sanitary operation.
  • Fail to ensure the presence of the holder of a valid Food Handler Certificate.
  • Fail to protect food from contamination or adulteration.
  • Fail to ensure equipment surface cleaned as necessary.
  • Fail to remove garbage when necessary to maintain sanitary condition.
  • Use food equipment not in good repair.
  • Fail to protect against harbouring of pests.
 

CONDITIONAL PASS

Restaurant

A conditional pass was issued after the following Food Premises Regulation infractions were observed during an inspection May 27.
  • Fail to protect food from contamination or adulteration.
  • Fail to protect against harbouring of pests.

Food Court Vendor

A conditional pass was issued after the following Food Premises Regulation infractions were observed during an inspection May 23.
  • Store potentially hazardous foods at internal temperature between 4C and 60C.
  • Fail to protect food from contamination or adulteration.
  • Use hand-washing station other than for hand washing of employees.

Restaurant

A conditional pass was issued after the following Food Premises Regulation infractions were observed during an inspection May 27.
  • Fail to ensure presence of food handler or supervisor during all hours of operation.
  • Fail to protect food from contamination or adulteration.
  • Fail to maintain hand-washing stations (liquid soap and paper towels).
  • Use food equipment not in good repair.
  • Fail to retain records of pest control measures taken for one year.

  • Fail to protect against breeding of pests.

A conditional pass was issued after the following Food Premises Regulation infraction was observed during an inspection May 27.
    Use food equipment not in good repair.

Restaurant

A conditional pass was issued after the following Food Premises Regulation infractions were observed during an inspection May 24.
  • Fail to ensure the presence of the holder of a valid Food Handler Certificate.
  • Use hand-washing station other than for hand washing of employees.
  • Fail to provide hand-washing stations with adequate supplies (hot and cold water).

Food Takeout

A conditional pass was issued after the following Food Premises Regulation infraction was observed during an inspection May 27.
  • Refrigerate potentially hazardous foods at internal temperature above 4C.

  • Fail to ensure equipment surface cleaned as necessary.
  • Mechanical equipment not constructed to maintain wash water between 60C and 71C.

Food Takeout

A conditional pass was issued after the following Food Premises Regulation infractions were observed during an inspection May 24.
  • Fail to protect food from contamination or adulteration.
  • Food premise maintained in manner permitting adverse effect on food.
  • Use food equipment not in good repair.

Restaurant

  • Fail to collect garbage when necessary to maintain sanitary condition.
  • Sanitize utensils in chlorine solution of less than 100 p.p.m. of available chlorine.

Food Court Vendor

A conditional pass was issued after the following Food Premises Regulation infractions were observed during an inspection May 23.

  • Refrigerate potentially hazardous foods at internal temperature above 4C.
  • Fail to ensure the presence of the holder of a valid Food Handler Certificate.

Restaurant

A conditional pass was issued after the following Food Premises Regulation infractions were observed during an inspection May 24.

  • Store potentially hazardous foods at internal temperature between 4C and 60C.
  • Fail to keep sanitary facility sanitary.
  • Fail to post licence adjacent to Food Safety Inspection Notice.
  • Fail to hold a valid Food Handler Certificate.
  • Fail to provide adequate number of hand-washing stations.
  • Fail to sanitize utensils as often as necessary.

What does Pass, Conditional Pass or Closed mean?

Closed

Every drinking and eating establishment in Toronto must, continually and prominently, post the most recent food safety inspection notice, as issued without alteration, at or near the main entrance.

There are three (3) types of notices:

A Pass notice will be issued when only minor or no infractions are observed during an inspection.

If Minor Infractions are repeated at the next inspection, the Public Health Inspector may issue a ticket to obtain compliance. Fines range from $45 to $370 depending on the severity of the infraction.

A Conditional Pass notice will be issued when one or more significant infractions are observed during an inspection.

When issued, a Public Health Inspector will re-inspect an establishment within 24-48 hours of the initial inspection. If the infractions are corrected and no other infractions or only Minor Infractions are found, a PASS Notice will be issued. If the infractions are not corrected by the time of the first re-inspection, a ticket will be issued and a second re-inspection will be conducted at a later date. If at the time of the second re-inspection the items have not been corrected, a summons to court will be issued and a referral to Toronto’s Municipal Licensing and Standards Division may occur.

A Closed notice will be issued when one or more crucial infractions observed during an inspection are not corrected immediately. A food establishment can only be closed when a health hazard is present.

An Order to Close the establishment and/or remove the health hazard will be issued. A Public Health Inspector will visit daily to make sure that the establishment remains closed. Failure to comply with an Order to Close will lead to additional charges. When all of the infractions listed in the Order and all other significant or crucial infractions are corrected, the establishment will receive a PASS Notice and may be re-opened. Any repeated or new crucial infractions may result in the operator being issued with a summons to court and referral to the Licensing Tribunal for further action.
